The RUDOLPH by Resfri Ar App provides USERS with access to RUDOLPH’s CONNECTIVITY SERVICE. The APP is made available by RUDOLPH Usinados SK s.r.o., a business entity registered under (IČO) 36 582 514, headquartered at Radlinského 17/B, 1280, ZIP Code 052 01, Spišská Nová Ves in Slovakia.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE RUDOLPH by Resfri Ar App. 

Acceptance of these TERMS OF USE and the PRIVACY POLICY is strictly required in order to use the app and our CONNECTIVITY SERVICE. By completing the registration process and/or using the features of the RUDOLPH by Resfri Ar App, YOU are deemed to have read and agreed to the rules and provisions of both documents.

IMPORTANT DEFINITIONS

APP: Refers to the RUDOLPH app, developed and published by RUDOLPH in the official Google Play Store and Apple App Store.


 USER or YOU: The individual using the RUDOLPH by Resfri Ar App.


 CONNECTIVITY SERVICE: Functionalities offered and operated via wireless communication between privately owned computing devices and RUDOLPH-manufactured products compatible with the data operation and transmission technology.


 REGISTRATION DATA: A set of information collected and processed by RUDOLPH relating to the identification of a specific USER.

CONNECTIVITY SERVICE AND SOFTWARE LICENSE

The CONNECTIVITY SERVICE offered by RUDOLPH enables the management of smart devices, allowing USERS to access, control, and create interactions between their own mobile computing device and SOFTWARE installed in compatible equipment sold by RUDOLPH.

The CONNECTIVITY SERVICE includes:
 (a) the possibility of remotely controlling compatible equipment;
 (b) the recording of technical information on the equipment’s lifecycle and usage reports for research and development purposes;
 (c) the recording of information supporting the provision of technical assistance, warranty validation and evaluation;
 (d) the recording of data and statistics enabling our analysis of RUDOLPH’s market presence.

Additional features may be improved, removed or modified at RUDOLPH’s discretion, based on updates and new versions.

By accepting these terms and conditions, RUDOLPH grants YOU the right to use the software developed for the CONNECTIVITY SERVICE. This license is limited, non-exclusive, non-transferable and non-sublicensable. Commercial use or personal use for purposes other than those described above is prohibited.

It is not permitted to use the generated information for the benefit of third parties or for data mining/mass processing by bots or similar tools, nor to use the APP for competitive analysis or public disclosure of its performance. Exceptionally, RUDOLPH may, upon request and analysis, grant express authorization for uses not initially permitted.

Incorporating the RUDOLPH by Resfri Ar App into any product or service YOU offer to third parties, or interfering with any mechanism intended to limit or protect the APP, is strictly prohibited. Reverse engineering of the software or hardware, or attempts to derive source code, algorithms, file formats, private APIs or trade secrets related to the CONNECTIVITY SERVICE or the APP, is also not permitted.

APP AND CONNECTIVITY SERVICE COMPATIBILITY

The compatibility of the RUDOLPH by Resfri Ar App with equipment manufactured by RUDOLPH depends on the purchase of an additional feature, sold separately. Ensure that your current equipment includes this option.

The CONNECTIVITY SERVICE is offered as an optional feature for the following devices:

  • RESFRI AR S1 AIR CONDITIONER (100AC);

  • SERIES 8 INSPIRE OR SERIES 8 INSPIRE INTERNAL CLIMATISER;

  • EV CHARGING STATION ECOVOLT (RES/ECOVOLT);

  • EXTERNAL REFRIGERATOR 110L, BIVOLT (RESGE110);

  • EXTERNAL REFRIGERATOR 67L, BIVOLT (RESGED67);

  • EXTERNAL REFRIGERATOR 75L, BIVOLT (RESGED75);

  • DRAWER FRIDGE MERCEDES ACTROS 25L, BIVOLT (RESGI25/ACTROS);

  • DRAWER FRIDGE VOLVO FH 32L, BIVOLT (RESGI32/FH);

  • DRAWER FRIDGE VW METEOR/MAN TGX 31L, BIVOLT (RESGP31/METEOR);

  • PORTABLE FRIDGE 18L, BIVOLT (RESGPD18);

  • PORTABLE FRIDGE 31L, BIVOLT (RESGP31) OR QUADRIVOLT (RESGP31/4V);

  • AUTOMOTIVE SOLAR KIT 0.2KWP (RES/KS01).

Devices not listed above or lacking Bluetooth® connectivity are not compatible with the RUDOLPH by Resfri Ar App. Installing the licensed software on other terminals or developing/using technologies for unofficial connections is strictly prohibited and may permanently damage hardware or software.

Other software that may appear compatible but is not developed or released by RUDOLPH is considered unofficial. Installing such software may cause unpredictable risks and vulnerabilities. RUDOLPH assumes no responsibility for the use of unofficial or unauthorised software.

Compatible operating systems are: Android 6.0 or later, and iOS 12.0 or later. Each USER is solely responsible for ensuring their device meets hardware, software, and system requirements for the CONNECTIVITY SERVICE.

USER REGISTRATION AND RESPONSIBILITIES

To access the CONNECTIVITY SERVICE, USERS must register personally and non-transferably. To register, the USER must:
 (a) be a natural person over 18 years old;
 (b) be legally capable of entering contracts under Brazilian law;
 (c) complete the registration form with accurate, correct, complete and updated REGISTRATION DATA.

Creating an account using third-party data is forbidden. Each USER is solely responsible for the accuracy and authenticity of their personal data and may be held civilly or criminally liable for any false information.

USERS are also responsible for keeping their login credentials secure and must not share them. Official communications from RUDOLPH will never contain attachments, executable files, third-party software, or external download links — only direct links to our site or partners.

RUDOLPH is not liable for any damage caused by malware or harmful elements on the USER’s device, or for failure to follow security best practices while using the CONNECTIVITY SERVICE. USERS must keep their devices secure and up to date.

While using the APP, USERS must not cause harm, infringe third-party rights (including copyrights), or overload, damage or interfere with the APP or its systems. Password hacking, reverse engineering or code manipulation is strictly forbidden. Likewise, attempting to view or manipulate server or product communication data without proper authorization or affiliation with our technical support network is not allowed.

In case of violations, RUDOLPH may deny registration, issue warnings, suspend or permanently delete user accounts — especially when data falsification is suspected.

RUDOLPH reserves the right to close accounts considered inactive for 6 (six) months or more. To avoid deactivation, log in at least once every 6 months.

INTELLECTUAL PROPERTY, PRIVACY AND TECHNICAL FAILURE SCENARIOS

All content in the RUDOLPH by Resfri Ar App — including information, tables, files, data, code, images, videos, graphics and other intellectual works — as well as general information obtained via the CONNECTIVITY SERVICE, logos, and the brand name RUDOLPH, are protected by intellectual property rights (copyrights, trademarks, patents, etc.). Accessing or purchasing products through the APP does not grant any rights beyond the intended use within the app.

RUDOLPH strives to ensure the APP is safe, accurate and reliable. However, due to technical limitations, RUDOLPH cannot guarantee permanent service availability. RUDOLPH is not responsible for outages caused by third-party systems, internet failures, power outages, telecom errors, or software/server issues.

Some CONNECTIVITY SERVICES may not be available in all areas, especially remote or closed locations, as they rely on wireless networks and, for some features, GPS.

RUDOLPH and its partners make no express or implied guarantees about the CONNECTIVITY SERVICE. The services are provided “as is”, including all potential flaws and interruptions.

By using the APP, YOU authorise the processing of your data as described in the Privacy Policy. We may also process aggregated, non-personal data for analysis and improvements. Automatically collected information for technical assistance and warranty purposes is presumed accurate. If misuse is detected, RUDOLPH may deny or limit warranty coverage.

GENERAL PROVISIONS

Content, policies and terms published on the SITE may be updated at any time by RUDOLPH. It is the USER’s responsibility to check for updates, especially when making new purchases. Tolerances or invalidations do not constitute novation and do not prevent enforcement of all other provisions.

RUDOLPH may send notices through various channels. YOU agree that electronic communications (email, SMS, push notifications) meet legal requirements for institutional communications. Notices are considered delivered on the next business day after sending.

In case of violation of these terms, RUDOLPH may notify involved parties and take legal action, including the suspension or termination of services.

The section divisions in these Terms of Use and the Privacy Policy are for reference only. Examples with expressions like “including”, “such as” or “for example” are illustrative, not exhaustive.

This agreement between YOU and RUDOLPH becomes effective from the date of acceptance and remains in force until YOU cancel the service by deleting your account in the RUDOLPH by Resfri Ar App.

This and other documents governing the relationship between RUDOLPH and USERS shall be interpreted according to European law. The competent court will be Spišská Nová Ves in Slovakia or, in the case of consumer relations, the USER’s local jurisdiction.
